Wills
We offer affordable estate planning documents for individuals and families. I can assist with will preparation or revision to an existing will. To get started, please use our Confidential Questionnaire (this PDF can be filed on your computer, or printed and filled out by hand and emailed or mailed back to us).
Simple Will – $350.00 (“simple” means that it provides the essential terms for a Maine will, but does not include trust matters for assets or minor children)
Reciprocal simple wills – $500 for both spouses or partners if the beneficiaries are identical.
Will with a Trust provision for children – $500.00. The provision provides for the terms of a springing trust that distributes assets for the benefit of the surviving children.
Reciprocal wills with Trust provision - $600.00 for both spouses or partners if the trust terms are identical.
Codicil (amendment to an existing will) – $250.00.
Financial Power of Attorney – $150.00. Grants the authority to manage your financial affairs and property.
Living will / health care directive: You can download this free form provided by MaineHealth. We can assist you in using the form.
Trusts
Revocable Trust - A trust that can be revoked or modified by the settlor. Can hold real estate and other assets. Limited creditor protections.
You can transfer real estate with a mortgage into a revocable trust if the current owners are the primary beneficiaries and there is no change in occupancy.
Irrevocable Trust - A trust with limited ability to modify or revoke without probate court approval. Provides greater liability protection.
Probate
We can also provide advice or representation on non-disputed probate matters. The process primarily designates the Personal Representative of the deceased’s estate at the local county probate court. This is billed at the hourly rate.
If the estate contains real estate, then a probate matter is required to allow the Personal Representative to convey the property.
